You must have the legal capacity to enter into binding contracts. You represent that you are not under any legal incapacity or restriction that would prevent you from using our services. If you are accessing our services on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

2.4 Single Account Policy

Each individual may maintain only one active account with Canuck Win Hub. Creating multiple accounts, whether to circumvent limits, restrictions, or for any other reason, is strictly prohibited. Detection of multiple accounts will result in closure of all associated accounts and forfeiture of any balances or prizes.

3. Account Registration and Security

3.1 Account Creation

To use our services, you must create an account by providing accurate, current, and complete information including your full legal name, date of birth, email address, phone number, and residential address. All information provided must match government-issued identification documents. Providing false or misleading information is grounds for immediate account suspension and may constitute fraud.

3.2 Identity Verification

As a licensed lottery operator, we are required to verify your identity. You agree to provide any documents reasonably requested for verification purposes, including government-issued photo identification, proof of address, and additional documentation as may be required to comply with anti-money laundering regulations and gaming laws. Failure to provide requested verification documents may result in account restrictions or closure.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password. You must notify us immediately of any unauthorized access to or use of your account. Maple Crown Jackpot will not be liable for any losses arising from unauthorized use of your account if you have failed to adequately protect your login credentials. You agree to:

3.4 Account Termination

We reserve the right to terminate or suspend your account at our sole discretion if you violate these terms, engage in fraudulent activity, or for any reason required by law or regulatory authorities.

4. Lottery Services and Ticket Purchases

4.1 Nature of Services

Maple Crown Jackpot acts as an authorized agent to purchase official lottery tickets on your behalf from licensed provincial lottery retailers. When you place an order through our platform, we physically purchase official tickets matching your selected numbers and securely store these tickets. We are not the lottery operator but rather a ticket purchasing service provider.

4.2 Ticket Selection and Purchase Process

You may select numbers manually or use our Quick Pick feature for random number generation. Once you confirm your purchase:

  • Payment is processed from your account balance or payment method
  • We purchase the official lottery ticket from an authorized retailer
  • A scanned copy of your ticket is uploaded to your account within 24 hours
  • The physical ticket is securely stored in our custody until after the draw
  • You receive confirmation via email of your purchase

4.3 Ticket Accuracy

While we take every precaution to ensure accuracy, you are responsible for verifying your ticket details before the draw takes place. Once you receive your scanned ticket, you should immediately check that:

  • The numbers match your selection
  • The draw date is correct
  • The game type is as ordered
  • All plays purchased are present on the ticket

Any discrepancies must be reported within 24 hours of receiving your scanned ticket. After this period, the ticket as shown in your account is considered accurate and binding.

4.4 Subscription Services

You may elect to participate in subscription services that automatically purchase tickets for future draws. By enrolling in a subscription:

  • You authorize us to charge your payment method or deduct from your account balance for each draw
  • Sufficient funds must be available in your account before each draw
  • You can modify or cancel subscriptions at least 24 hours before the next scheduled draw
  • Failed payments will result in missed draws, and we have no obligation to make up missed purchases

4.5 Order Cancellation and Refunds

Once a lottery ticket purchase is confirmed, it generally cannot be cancelled or refunded as we have already purchased the official ticket on your behalf. However, if we fail to purchase your ticket before the draw cutoff time due to technical issues or other circumstances within our control, you will receive a full refund. Refunds are not available for:

  • Tickets that have been successfully purchased and recorded
  • Losing tickets after the draw has occurred
  • Customer errors in number selection (you must verify your ticket upon receipt)
  • Tickets that cannot be purchased due to insufficient account balance

5. Prizes and Winnings

5.1 Prize Notification

We automatically check all tickets after each draw and notify winners via email and SMS. You are responsible for maintaining current contact information in your account. We are not liable for failed notifications due to incorrect contact information, spam filters, or other delivery issues. You should regularly check your account for winning tickets.

5.2 Small Prize Claims (Under $10,000)

Prizes under $10,000 are automatically credited to your Canuck Win Hub account balance within 48 hours of draw result verification. You may then withdraw these funds to your bank account or use them to purchase additional lottery tickets. No additional claim process is required for these prizes.

5.3 Large Prize Claims ($10,000 and Above)

For prizes of $10,000 or more, you must follow the official lottery corporation's prize claim process. Maple Crown Jackpot will:

  • Notify you immediately of your win
  • Provide the original physical ticket to you or accompany you to the lottery office
  • Assist with completing necessary claim forms and documentation
  • Provide support throughout the claims process

Large prizes are paid directly by the provincial lottery corporation, not by Maple Crown Jackpot. Winners are responsible for any applicable taxes on prize winnings.

5.4 Unclaimed Prizes

You must claim prizes within the time period specified by the provincial lottery corporation (typically one year from the draw date). After this period, unclaimed prizes are forfeited and we have no obligation to pay or assist in claiming expired prizes. We will make reasonable efforts to notify you of significant wins, but ultimate responsibility for claiming prizes rests with you.

5.5 Tax Obligations

In Canada, lottery winnings are generally not taxable. However, you are responsible for understanding and complying with all tax obligations in your jurisdiction. For prizes exceeding certain thresholds, we are required to collect your Social Insurance Number and report winnings to tax authorities as mandated by law.

6. Fees and Payment Terms

6.1 Service Fees

Maple Crown Jackpot charges no additional service fees beyond the face value of lottery tickets. The price you pay is the same as you would pay purchasing tickets directly from a retailer. We generate revenue through commissions paid by lottery retailers, not through markups on ticket prices.

6.2 Payment Methods

We accept the following payment methods for adding funds to your account:

  • Interac e-Transfer
  • Bank transfers (for large deposits)

  • Do not earn interest
  • Are held in trust and not commingled with company operating funds

6.4 Withdrawals

You may withdraw funds from your account balance at any time by requesting a bank transfer or other approved withdrawal method. Withdrawals are subject to:

  • Anti-money laundering checks for large amounts

Withdrawals must be made to payment methods registered in your name. Third-party withdrawals are prohibited to prevent money laundering and fraud.

  • Launder proceeds from illegal activities
  • Make deposits followed by immediate withdrawals without playing
  • Transfer funds to other users
  • Use our services as a payment intermediary

8.3 System Abuse

  • Attempting to access other users' accounts
  • Introducing viruses or malicious code
  • Scraping or data mining our platform
  • Reverse engineering our systems
  • Interfering with the operation of our services

8.4 Consequences of Violations

Violation of these terms may result in:

  • Immediate account suspension or termination
  • Forfeiture of account balance and prizes
  • Reporting to law enforcement authorities

Our platform relies on third-party services including lottery corporations, payment processors, and technology providers. We are not responsible for failures or errors by these third parties that may affect your ability to purchase tickets or claim prizes.

10.3 Winning Odds and Outcomes

All lottery draws are conducted by official provincial lottery corporations. We have no control over draw outcomes, winning numbers, or odds of winning. Past results do not influence future draws, and each play has an independent chance of winning based on the official lottery odds.

10.4 Limitation of Liability

To the fullest extent permitted by law, Maple Crown Jackpot and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Unauthorized access to or alteration of your account
  • Technical failures or errors in ticket purchases
  • Third-party conduct or content
  • Any other matter relating to our services

Our total liability to you for any claim arising from or relating to these terms or our services shall not exceed the amount you paid to Maple Crown Jackpot in the twelve months preceding the claim, or $1,000 CAD, whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold harmless Maple Crown Jackpot and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms of Service
  • Your use or misuse of our services
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

12. Dispute Resolution

12.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12.2 Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these terms or our services shall be settled by binding arbitration in accordance with the Arbitration Act of the applicable province. The arbitration shall be conducted in English in the province of your residence. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Before initiating arbitration, you agree to first contact us and attempt to resolve the dispute informally by sending written notice to [email protected] describing the dispute and your desired resolution. We will attempt to resolve the dispute within 30 days of receiving your notice.

13. General Provisions

13.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Canuck Win Hub regarding our services and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by an authorized representative of Maple Crown Jackpot.

13.4 Assignment

You may not assign or transfer these terms or your account to any other person or entity. We may assign our rights and obligations under these terms to any affiliated company or in connection with a merger, acquisition, or sale of assets.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
